§ 1-7. Certain ordinances and offenses not affected by Code.

  • (a)

    Nothing in this Code or the ordinance adopting this Code shall be construed to repeal or otherwise affect the validity of any of the following:

    (1)

    Any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the effective date of this Code.

    (2)

    Any ordinance or resolution promising or guaranteeing the payment of money for the town or authorizing the issuance of any bonds, including revenue certificates, of the town or any evidence of the town's indebtedness or any contract or obligation assumed by the town.

    (3)

    Ordinances and resolutions granting permits or franchises.

    (4)

    Ordinances and resolutions adopted for purposes which have been consummated.

    (5)

    Ordinances and resolutions which are temporary, although general in effect, or special, although permanent in effect.

    (6)

    Ordinances and resolutions relating to salaries or expense allowances for town officials or employees.

    (7)

    Ordinances and resolutions relating to annexation of territory to the town.

    (8)

    Ordinances and resolutions naming, renaming, opening, accepting or vacating streets or alleys in the town.

    (9)

    Ordinances and resolutions making appropriations.

    (10)

    Ordinances and resolutions relating to the budget.

    (11)

    Ordinances and resolutions consistent with this Code ordering or dealing with elections.

    (12)

    Ordinances and resolutions making appointments to positions, offices or boards.

    (13)

    Ordinances and resolutions providing for local improvements or levying assessments for improvements.

    (14)

    Ordinances and resolutions authorizing contracts or bonds for the payment of money.

    (15)

    Ordinances and resolutions authorizing deeds, leases, contracts or other instruments to or with named persons or corporations.

    (16)

    Ordinances and resolutions under which vested rights may be accrued as to persons in whom such rights may have vested.

    (17)

    Ordinances consistent with this Code levying any tax, fee or charge, by whatever name known.

    (18)

    Personnel policies, rules and procedures.

    (19)

    Ordinances regarding law enforcement.

    (b)

    All such ordinances are hereby recognized as continuing in full force and effect to the same extent as if set out at length in this section.
